The AIHRC welcomes the overturning of Capital Punishment to Mr. Sayed Parwiz Kambakhsh by the court of appeal, but it is still concern over the lack of due process in proceeding of this case.
Considering that the rights and freedoms, enshrined in the Country�s Constitution are applicable to all citizen of the country, and considering that every individual has the right to enjoy a just and fair trial, and is entitled of a range of human rights guarantees during arrest, investigation and trial. The AIHRC expresses its concern regarding the process of judicial practices and the way the case of Mr. Parwiz Kambakhsh was judicially handled by the Primary Court of Balkh Province and Appeal Court of Kabul Province.
Mr. Sayed Parwiz Kambakhsh has the right to appeal to the Supreme Court of Afghanistan for his final judicial proceeding, therefore, the AIHRC calls upon the Judicial Authority of the country for a full realization of a free and fair trail in the case of Mr. Parwiz Kambakhsh in accordance with the provision of constitution of Afghanistan.
A full respect of due process and standards of fair and free trail will enhance the public's trust to an independent judiciary and will encourage further flourishing of freedom of expression and media in Afghanistan.
